Sworn and Court-Certified Experts and Private Expert

Sworn and court-certified experts are those individuals who, following a specific certification process, are entered into the list of court-appointed experts maintained by the presidents of the regional courts (sdgliste.justiz.gv.at). This is a personal certification under the Experts and Interpreters Act (SDG), which includes a quality assessment and ensures that only highly qualified, absolutely honest, and reliable experts are appointed as court-appointed experts.

Requirements for certification include, among other things, expertise, relevant professional experience, knowledge of procedural law, expert witness procedures and methodology, the necessary equipment for expert witness work, sound financial standing, and liability insurance.

Private experts do not act on behalf of a court (official) but rather on behalf of a party. This is particularly relevant for:

Assessing the prospects of success and preparing for legal proceedings

Reviewing expert opinions provided by court-appointed experts

Preparing for the questioning of court-appointed experts.

Private experts enter into a private-law relationship with their clients.
